Can a foreigner holding a residence permit in France become self-employed ?

The law of January 28, 2024 amended a number of articles of the CESEDA, as well as the French Commercial Code.
Article L526-22 of the French Commercial Code contains a new paragraph stipulating that non-EU nationals who do not hold a residence permit "authorizing them to practice" as a sole practitioner (self-employed or entrepreneur in French) cannot benefit from this status.
This means, for example, that a holder of an "passeport talent-salarié" is not authorized to set up an individual company.
However, there are exceptions (spouses of French nationals, cartes de résident, passeport talent-création d'entreprise or titre de séjour profession libérale).
